1. Acceptance of Terms

By creating an account or using ProtoFitSense AI, you agree to these Terms of Service. If you do not agree, do not use the service.

2. Health & Fitness Disclaimer

ProtoFitSense AI is not a substitute for professional medical advice, diagnosis, or treatment.

The AI-generated training programs and coaching advice are for informational and educational purposes only. Always consult with a qualified healthcare provider before starting any new exercise program, especially if you have pre-existing health conditions, injuries, or are recovering from surgery.

You exercise at your own risk. ProtoFitSense AI and its operators are not liable for any injury, health issue, or damage resulting from following AI-generated training recommendations.

3. Account & Eligibility

• You must be at least 16 years old to use ProtoFitSense AI.
• You are responsible for maintaining the security of your account credentials.
• One person per account. Do not share account access.

4. Subscriptions & Billing

• Free tier: Limited daily AI usage, basic workout tracking and analytics.
• Pro subscription: Unlimited AI coaching, full program generation, advanced analytics, and all premium features.
• Pro subscriptions auto-renew at the end of each billing period (monthly or annual) unless canceled.
• You can cancel at any time. Access continues until the end of the current billing period.
• Refunds: For subscriptions purchased through the App Store or Google Play, refund policies of Apple/Google apply. For web subscriptions via Stripe, contact us within 7 days of purchase for a refund.
• Free trial: New Pro subscribers receive a 7-day free trial. You will not be charged during the trial period. Cancel before the trial ends to avoid charges.

5. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose.
• Attempt to reverse-engineer, scrape, or abuse the AI features.
• Circumvent subscription restrictions or usage limits.
• Share or redistribute AI-generated content commercially without permission.

6. AI-Generated Content

Training programs, coaching advice, and exercise suggestions are generated by AI (Google Gemini) and may contain errors or inappropriate recommendations. While we implement safety rules (especially around injuries), the AI is not infallible. Always use your judgment and consult professionals when in doubt.

7. Data & Privacy

Your use of ProtoFitSense AI is also governed by our Privacy Policy. You can delete your account and all associated data at any time.

8. Limitation of Liability

ProtoFitSense AI is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to physical injury, loss of data, or loss of profits.

9. Termination

We reserve the right to suspend or terminate accounts that violate these terms. You may delete your account at any time from your profile settings.

10. Changes to Terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance. We will notify you of material changes via email or in-app notification.
